Анотація
У статті досліджено проблему військових злочинів проти довкілля в умовах збройної агресії Російської Федерації проти України. Проаналізовано міжнародно-правові акти, зокрема Протокол І до Женевських конвенцій та Римський статут Міжнародного кримінального суду, які встановлюють стандарти захисту природного середовища у воєнний час. Розглянуто українське законодавство, зокрема ст. 441 Кримінального кодексу України («Екоцид»), а також сучасну практику фіксації екологічних збитків війни. Зроблено висновок про необхідність посилення правових механізмів відповідальності та міжнародної співпраці для належногозахисту довкілля у період збройних конфліктів.
WAR CRIMES AGAINST THE ENVIRONMENT: INTERNATIONAL LEGAL ASPECTS AND UKRAINIAN CONTEXT
Abstract
The paper examines the problem of war crimes against the environment in the context of the armed aggression of the Russian Federation against Ukraine. International legal instruments, including Protocol I to the Geneva Conventions and the Rome Statute of the International Criminal Court, which establish standards for the protection of the natural environment during wartime, are analyzed. Ukrainian legislation, in particular Article 441 of the Criminal Code of Ukraine (“Ecocide”), as well as current practices of recording environmental damage caused by the war, are considered. The conclusion emphasizes the need to strengthen legal mechanisms of responsibility and international cooperation to ensure adequate protection of the environment during armed conflicts.
